Legislative definition

Section 199 of the Labour Code defines so-called other important obstacles at work, where the employer must provide us with time off work and, in specified cases, wage compensation. The scope of these obstacles, including the minimum period of time off work, was established by the Government by Regulation No. 590/2006 Coll.

How long does your employer have to release you

The government regulation requires employers to grant leave to move for a strictly necessary period of time - up to a maximum of 2 days - in the case of a change of residence for an employee who has his own housing facilities and is moving of his own free will. The Labour Code specifies this provision more benevolently - according to the Labour Code, leave may be granted for a longer period if the employer agrees with the employee in advance.

Definition of own home furnishings

Home furnishings are mainly furniture, appliances and other common household equipment. In practice, of course, no one will examine exactly what you are moving. The purpose of this provision is to prevent requests to vacate by employees who are not moving their own furnishings but, for example, a friend's furnishings.

Paid time off for moving

If you move on your own initiative, you are not entitled to a salary replacement. The only exceptions are if your employer has reassigned you to another workplace and you are moving in its interest. In that case, they must reimburse your wages or salary in full.

Holidays vs. time off work

From an economic point of view, it will definitely be more economical to take a day off work to move to your new home, as you will be reimbursed for this day. Another option is to do everything on the weekend, when the company Moving Prague works without any extra charge.

Moving within the notice period

If you need to prepare properly for all the changes, there is still the option of taking time off work to find a new job. If you are on the standard two months' notice, your employer must give you 1 half day a week to look for a new job. You can also combine these terms to get up to 2 days off in total per month.

If you give notice yourself, this time off will be unpaid. If your employer has given you notice because of an obstacle on his/her side or because you are unfit for work for health reasons, you will also be entitled to compensation for the time spent looking for a new job.
